Judicial Fiat? Despotism of an Oligarchy

After reading the article linked below, consider this quote from one of our Founding Fathers, Thomas Jefferson, when talkin about courts – wrote “The true barriers of our liberty are our state governments” and “to consider the judges of the Superior Court (U. S. Supreme Court) as the ultimate arbiters of constitutional questions would be a dangerous doctrine which would place us under the despotism of an oligarchy… I know no safe depository of the ultimate powers of society but the people themselves.” This is one of the authors of the Constitution of the United States of America mind you.

So a state law, passed by the General Assembly that reflects the will of the people of the state of Tennessee – is halted by a court. Ultimately leading us to the despotism of an oligarchy when the case below lands up on the docket of the U.S. Supreme Court.
